George Zimmerman’s defense attorney Mark O’Mara is scheduled to face off with Circuit Judge Kenneth Lester for the first time since O’Mara has asked for his recusal. Honorable Judge Lester will hear motions on at least two issues. One will be the matter of Prosecutor Bernie de la Rionda’s request for additional medical records and the other is to decide whether Judge Lester will allow Zimmerman to travel outside of Seminole County. It’s not yet known if George Zimmerman will personally attend. The hearing is set for today at 8:30 am.
State Requested Additional Medical Records
According to gzlegalcase.com George Zimmerman through his counsel Mark O’Mara has filed “Notice of Objection to Subpoena“ objecting to the State’s request for additional medical records. In the notice O’Mara asserts lack of relevance. O’Mara has agreed to review the records and would prefer that he decide as what is relevant to the case.
In response, Assistant State Attorney Bernie de la Rionda agreed that several pages have been provided so far concerning Zimmerman’s treatment at the Altamonte Family Practice on February 27 but he is seeking notes, photographs, X-Rays, CT scan, MRI or anything else related to his treatment that day after the shooting. The State wants to make sure no other records exist.
De la Rionda went further saying at various times Zimmerman and/or his attorney “have asserted that the Defendant’s head was repeatedly beaten into concrete, and that he sustained some injuries to his head, and a broken nose after the struggle with Trayvon Martin on 2/26/2012.”
He said, “the records provided by Altamonte Family Practice describe what Defendant claims happened when he came in contact with Trayvon Martin, as well (as) treatment administered by a physician assistant,” and they refer to Zimmerman being informed that he should be seen by an ear, nose and throat doctor, which he refused to do.
George Zimmerman Asks to Leave Seminole County
Also expected in Friday’s hearing, Judge Lester will rule on another issue. Attorney Mark O’Mara has requested in a motion filed today to ask the court to allow George Zimmerman to leave Seminole County.
It was ruled by Circuit Judge Kenneth Lester in his second bail order that he, George Zimmerman reside within Seminole County. Defense attorney Mark O’Mara says that this ”has had an ongoing, deleterious effect on his ability to assist in the preparation of his own defense.” He is asking Lester to modify the conditions of Zimmerman’s release and lift the restriction requiring him to live in Seminole County.
Mark O’Mara further complained that communications have been “unnecessarily” limited to telephone calls and his occasional visits to Zimmerman’s safe house.

On July 13, George Zimmerman’s attorney Mark O’Mara petitioned the court to disqualify Judge Kenneth Lester Jr. In a Motion to Disqualify Judge Kenneth Lester O’Mara sought to recuse the presiding Judge because of the wording he used to describe George Zimmerman’s character.
After reading the July 5th “Order Setting Bail” Mark O’Mara said his client George Zimmerman questioned the judge’s ability to be objective and was particularly concerned with Judge Lester’s description of Zimmerman’s character which O’Mara described as containing “gratuitous and disparaging” remarks. In response, Judge Lester did not directly address that accusation but he did say that the motion to disqualify him was “legally insufficient” and he refused to step down.
In a last ditch effort, defense attorney Mark O’Mara filed a Writ of Prohibition petitioning the Fifth District Court of Appeal to review the trial judge’s refusal to remove himself from the case, after the defense requested it citing what it considers bias against their client. This matter is still pending.
George Zimmerman is due to stand trial on charges of 2nd Degree murder in mid-2013 for the fatal shooting an unarmed 17 year old teenager named Trayvon Martin.

Interestingly, since GZ is in a safe-house and O’Mara’s office location is known, why would O’Mara think that GZ is safe coming to his office?
I seriously doubt that GZ’s medical records as of and after 2/27/12 are going to produce anything to verify that imaging was taken of his nose. This has to frustrate O’Mara because “hearsay” about injuries without medical tests can be disputed. GZ was talking fine the day after his nose was purportedly broken. He wasn’t grunting or showing any signs of pain in the re-enactment. Neither did he show any emotions.
Why does GZ want to leave Seminole County so badly? Cost of living expenses? Bull! He wants to avoid prosecution. GZ will take off like a migrating bird to not be seen again.

O’Mara has been playing to GZ’s fans. He has played the role of the circus barker in hopes of satisfying them to get donations. My guess is that GZ joined in with his fans insisting that O’Mara litigate the case their way. But now O’Mara must realize that they are directing but not donating.
If I were a betting person, I would bet that he gets a call from the FBI almost daily basis to alert him of the fans’ hate-speech on social internet sources that GZ was monitoring. O’Mara said something to Piers Morgan that he was returning donations submitted with notes that expressed racism. Possibly, the FBI wants to make sure of that. If GZ accepts money from them, then he gives them reason to believe that he shares and agrees with their views and racial bigotry.
There’s that attorney-speak again — he said he took the FB page down because they were discussing GZ’s guilt or innocence. It’s not that I want to make excuses for him, but O’Mara has had to COMPETE with the legal advice of GZ’s fans. Then too there’s papa Zim and junior who is probably also telling O’Mara what to do.
O’Mara needs to grow a pair and stop trying to be a father-figure to GZ and get on with explaining to GZ all of the evidence that’s against him in addition to evidence that he doesn’t have to support his story.

In general criminal defense attorneys don’t like to withdraw. If they feel it is necessary to do so, they have to motion the court for approval. The courts do not like granting those motions unless it’s before discovery has been completed, which is probably one reason why O’Mara continues to say that he has only received a percentage of the State’s discovery. He has not began taking depositions yet either.
Well, as we have heard, his appeal of “if you feel like George” has not resulted in people giving their money to a liar and deceiver. I do believe that some who donated to him early on feel betrayed that he used the money to get out of debt, rather than paying his current living expenses and saving the rest for legal defense.
Then came the matter with Shellie being arrested and charged. While some GZ fans believed they were donating to him, they don’t intend to also support his wife.
Then there is the hard reality that GZ simply does not have those many fans who support him personally. They are opportunists, using the case to voice their racial hatred, or support of guns, or support of SYG which they believe gives them privilege to kill others without consequences. I am of the impression that GZ knows this, and is why he attempted to appeal to religious extremists (it was God’s plan) and Latinos on his web site (thanking them in Spanish). However, it does not appear that he gained one additional financial contributor and actually lost others. Those same opportunists would find it insulting that he would appeal to Latinos. They do not want equality for gun ownership and SYG but to keep entitlement of those things for themselves.
O’Mara’s office is in Orlando, which is in a county other than Seminole. The inconsistency in his argument however, is that GZ is not safe living in Seminole County, but needs to come to his office in Orlando where the address is known by anyone who wants it. Anyone who wants to follow GZ from that office to his safe-house can. They’ll probably be reporters camp-out on around O’Mara’s office with binoculars!!!
And the thing is, since GZ abandoned his job and left his home the weekend after he killed Trayvon, he created his own situation before this case gained media attention. What was he going to do had it not gained media attention, and if he had not been charged? How was he going to support himself and where was he going to live?

I agree on religious extremists being tight wads, and include in that, that extremists do not give any honor to Roman Catholics, which GZ claims to be. If members of that denomination have not come to his aid, he can forget Protestants doing so.
Right now O’Mara is probably kicking himself in the butt for motioning the court to give GZ another bond. He should have let him stay in jail and avoided all the problems with additional expenses for security. As well, he would have avoided preparing the petition to recuse Judge Lester, and the appeal, saving himself from accumulating those legal fees.
Now, if GZ can figure out where he will live outside of Seminole County so that jurisdictions can coordinate to monitor the GPS ankle bracelet, O’Mara has yet another petition to prepare, file, and appear in court for the hearing.
O’Mara is spending a LOT of time and accumulating legal fees for matters that have nothing to do with building GZ’s defense. And, he has to be GZ’s quasi-banker too!!!
Well, maybe this is GZ’s way of keeping O’Mara busy because he knows his only defense is “He hit me first and broke my nose so I had to shoot him.”

Attorneys can withdraw, paid or pro bono. That in fact, (in least in civil matters), attorneys can withdraw on the basis that the client has failed to pay them as agreed.
However, they have to motion the court to withdraw, and it’s up to the judge’s discretion. Most judges do not allow withdrawal post discovery because it can place the subsequent attorney at a disadvantage.
O’Mara is receiving discovery material, but he is not doing any discovery of his own. In fact, he might be holding off to see what the Appellate Court decides on the appeal to replace Judge Lester before he files a motion to find GZ indigent. IMO, GZ is indigent due to his own decisions.

About the pro bono — it depends on the lawyer. Most that I know only take pro bono cases if they won’t take their time and attention from cases that pay the bills. Some will take a high profile case pro bono if it helps to compel their reputation resulting in more clients.
GZ gives me the impression of being a person that wants exclusive attention. I have no idea how many other cases O’Mara might have, but it has to be a burden catering to GZ’s demands.
Who knows why O’Mara took the case pro bono? While he was commenting on radio, he said that GZ had a good chance to prevail because of SYG. Now, SYG is out of the door and standard self-defense enters. Had he known then what he does now, he may not have taken on GZ as a client at all.

We made the call to stay since I don’t have any kids to worry about. I’ve got food, water and batteries. The only thing I’m really worried about is my dog. She’s a 110lb St. Bernard/Collie mix. I don’t know how she’ll handle the heat if we lose electricity? Hopefully we won’t or if so it’ll just be for a day or two. But if worst comes to worst, I told my friend in Lafayette, I’ll go to her place. Sooo..we’ll see..so here I am, fat, dumb and happy.. waiting for Isaac. lol

That’s a BIG dog!!! They do survive in hot weather as long as they have plenty of water. This may sound weird, but fill your bathtub up with cold water. You can scoop it from there for cleaning hands, little wash-ups, and your dog. If you have spray bottles in the house, they serve good for cooling the dog if he/she doesn’t mind being sprayed with water.

We had total electricity and the neighbors across the street had gas.

First time that we ever flooded was tropical storm Allison.
My husband even said that we had better get things up high. I looked at him like he was crazy.

Here’s how stupid I was, I started getting blankets towels and any thing that I could at the doors and went in to pack my suitcase.
When I put it on the floor and started to pack was the first time EVER that I found out it comes up through the floor. It was too late to leave then. Of course our cats went spastic. The one not so spastic we got him in a carrying kennel and tried to get the other cat but, he was nowhere to be found. But, we knew he was in the house. We stayed up all night.The next morning it looked like we were sitting in the ocean.
We only got 4 inches in the house, but it sure made a mess.
Many went to bed that night just thinking we we having a lot of rain.
A man got out of bed in his two story house.
The water was already up to the top of his stairs.

Help Xena?? Lolypop!!! Okay. Can’t say I know much about it. The last I heard, a person can refuse a breathalizer if suspected of DUI, but their license will be suspended anyway. There may be some right to privacy, constitutional mumbo-jumbo. Warrants are not difficult to get. That’s what magistrate judges are for — like papa Zim. But, I think the person has to actually be arrested before a warrant for drug testing is issued. Don’t quote me on that.
The testing on the deceased would be to determine cause of death. It’s standard procedure because a person who looks like they died in a fire may have been poisoned before the fire was started. Or another example would be Whitney Houston. The ME said the cause of death was accidental drowning, but after the toxicology report, said that drugs contributed to it.
Had GZ gone to the hospital, he would have been required to sign a consent form for treatment. If a physician ordered blood and/or urinalysis, he would not have had a choice about it. Refuse = discharge without further services. The result of his labs would need to be subpoenaed for use in the case, but at least they would exist. GZ had reason(s) for not going to the hospital that had nothing to do with what his insurance did not cover — just as he had reason not to see an ENT Specialist for that purported broken nose.

Oh ..you poor thing..flooding is the worst! Yep, water comes up thru the floor. I’m sure you’ll never forget going thru all of that. It’s freaky how fast the water can rise during those storms. Allison was caused a lot of mess. Its not fun cleaning up after a flood…that’s for sure.
Yes, I was in Houston during Ike. I leave one city because of a hurricane and then I have to go thru another one. Ike was the scariest one I’ve been in, though. Wow.
OMG Loly, you know I forgot about all of the deaths from Hurricane Rita. That was so sad. There was a pile up on I-10. And you’re exactly right..it was because people were so fearful from Hurr. Katrina. Thanks for reminding me..just how dangerous these storms can be.
2005 was a bad year, remember? There were 3 – cat 5 hurricanes, Katrina, Rita and Wilma IIRC..which was very unusual.

If he had been arrested, he would have been in jail. While he was held at the police station that night, they could have gotten a warrant. In fact, had they wanted to drug test, they would have pursued that warrant while Singleton was questioning him.

There’s nothing in the bond order that prevents GZ from giving tv interviews — as long as he doesn’t leave Seminole County. Hi Loly & Xena…I think we can safely say that JB has no electricty.I like you Loly hope & PRAY that JB & Fluffy are cool,dry & being fed!! I keep watching CNN hopeing for some smoke signals or something! All I keep seeing are heart breaking people loosing their homes hauling their pets thru the water! JB did tell us they were all PREPARED except for Fluffy getting too hot.I remember when we had all those tornadoes,lost electricity,I had a little gizmo that was a tall water bottle with a battery operated FAN on top of it,I ended up falling asleep with that on my stomach! Whoa…!!! What-a-Storm!! Isaac stalled on my door step for at least 9 hours. He lulled halfway over the gulf which was our biggest problem because he didn’t weaken like hurricanes normally do when the reach land. From about 11pm til 8am this morning, 50mph winds were tearing at my big Magnolia tree, I actually thought the tree was going to crash into my house. That was scary.
For a little Cat-1 hurricane, it was bad. Thankfully at about 6pm today, the rain and wind finally died down enough for Energy to get our electricity back up now I can breathe a sigh of relief.. except for having to rent a Wet Vac tomorrow to suck all of the water out of my bedroom carpeting, it wasn’t too bad. Fluffy is doing fine, all she needs is a bath. Poor baby was scared to death going outside to potty but she did it, just got a little muddy.
Other than that all is well. Now I have to catch up on ZBoy.

I’m still here, alive and kicking. Right now I think they’re expecting more flooding for the northshore. We call it the northshore cuz its north of Lake Pontchartrain. It seems since the Feds spent 10 billion on a new levee system for the New Orleans area, the northshore is flooding like they never did before so they’re complaining. They think it’s because of the new levee system.
I live 12miles from the French Quarter, we were first to get hit and first to get back electricity. We’ve seen the worst so it’s good for us but sadly some folks “up north” aren’t doing so well. I feel badly for them. Flooding sucks! I’d take wind damage anyday before having to deal with water damage. Loly, I’m sure you know.
But on a happy note, it’s ” Cook it or Lose it ” Shrimp n Grits for everybody! That’s what one of the fine restaurants in Slidell, LA is doing. They lost power but no flooding so they’re cooking up all their best dishes on gas stoves for their Slidell neighbors. It’s free. Thats so cool.

Lolypop, Shellie hasn’t been sentenced yet. She awaiting trial, and the judge in her case is the same as in GZ’s case. Who knows what is going to happen now???
GZ is playing Russian Roulette and has already pulled the trigger 4 times. Surrogates; Hannity; perjury in court; replacing Judge Lester. Two more moves to go then “boom.”

Hello everyone. It has been a loooong week here — but at least I didn’t have to deal with a hurricane.
JB, I hope your bath tub didn’t overflow due to my suggestion that you fill it with water as a type of “reserve” in the event you lost power and water. I feel so guilty now!!!! Hopefully you can find that wet-vac.
Lolypop, Shellie plead guilty, and she has a hearing coming up in Sept. that will set dates for discovery and pre-trial motions. I can’t imagine what evidence or defense she has. Her knowledge and transferring of the money is all recorded and documented. Now that the same judge has been assigned to GZ’s case, there might be a motion to recuse the judge in Shellie’s case.
Maybe this was planned all along, and we know that Shellie cannot go before Judge Lester. I see a process to eliminate all Seminole County judges. Based on recorded calls from jail, GZ hinted a preference for retired Judge Eaton who O’Mara considered as a better bet for GZ to win an immunity hearing. I hope that the State remembers that call.
BUT, GZ and Shellie have a huge problem — they assumed that money was going to be pulled off trees and sent to them. Delaying their cases serve no benefit other than to keep them out of jail — and they cannot afford to continue living out of jail.

There are so many things to do to get ready for a hurricane, it would be easy to forget
something like that, but it sure isn’t your fault and JB know’s that and she
wouldn’t want you to feel guilty.

It’s been another late night, so I suspect I’ll sleep until late afternoon — no hurricane here, just an old lady who stays up late. LOL!!
No way can litigants request the judge they want. They can’t even choose the venue if they want a change. That is decided by the Chief Judge.
GZ gives papa Zim too much credit. His job was as a magistrate judge in VA. His position does not require a law degree. Magistrate judges do not decide issues at law. They sign warrants, subpoenas, hear and rule on pre-trial matters. It would be a big mistake taking legal advice from papa Zim just as much as it would be a big mistake taking legal advice from a clerk of the court. They are procedural folks — not lawyers. When I heard papa Zim’s interview with the State’s Attorney, he talks matter-of-factually — but that doesn’t mean anyone has to dance to his music.
GZ has to walk this road alone. I can hardly wait to see Osterman on Dr. Phil’s program and wonder, why do they continue running off at the mouth when there is a murder case pending?

Guys….I gotta tell Yall I got so DISGUSTED the other day when Judge Lester was kicked off,I had a melt down!! This is a bunch of musical judges down there & a JOKE! How many BREAKS does GZ get? He whines about something & gets it.And people had the nerve to talk about Casey Anthony being catered to? Are you kidding me right now?! She couldn’t get a break.Florida let the same judge that went on Nancy Grace to rip Casey a new one also demand she do probation she had already done.I still don’t see WHERE Judge Lester was unfair,biased,etc & I read all the transcripts!! Dear Lord…we all can read & listen to what GZ,SZ,friends & family have done!!
It looks like we are fixing to get more info from the Ostermans !! If you read around now they are being labeled as GREEDY.Well that would explain why they were such close friends with G & SZ!!

The floods caught people by surprise.

George Zimmerman was given a very small bond to begin with. HE LIED to the court.
The court can’t repremend him??? Since when??
First he’s charged with second degree murder, second he LIED to the court before he was even given that bond.
The judge is supposed to say “man I feel for you” AND pity him.

SO, the judge let’s him out on a million dollar bond. POOR BABY GEORGE!!
He was DAMN lucky to even get out on bond.
He’s a spoiled brat, used to getting what he wants and will pitch a fit if he doesn’t
get his way.
But this time HIS WAY may just bite him in the ass.
And George’s friends and CO. think they’re going to help by going on TV appearences?

And another thing some that are in the homes sleeping thinking they were safe and a tree falls on the house and kills someone.
During one of our worst ones, I think there was ONE person killed and that was by a tree falling on the house.
Have the waters started subsiding any.
Yes, some totally lost their homes. That surprised me it being a Hurricane ONE!!
